Last Will and Testament of Nathaniel McKinney

Rockingham County

I, Nathaniel McKinney of the County of Rockingham and State of North Carolina, being of sound mind and memory, but consdering the _______ of my earthly existance, do make and delcare this my last will and testament, in manner and form following that is to say:

First, consigning my body to God, who gave it and my soul to Christ, whose attonement I trust has saved it; I desire that my executors hereinafter named shall provide for my body a descent burial, suitable to the wishes of relatives and friends, and pay all of my funeral expenses, together with my first debts, howsoever and to whomsoever _____, out of the money that first came into thus hands as a part or parcel of my estate.

Item 1 - I give and bequeath to my daughter, Fannie Scarlett one hundred dollars ($100.00); to my daughter Martha Delancy one hundred dollars (100.00); to my son G. C. McKinney five dollars ($5.00); to my son Wm. B. McKinney fifteen dollars ($15.00); to my son T. J. McKinney seventy-five dollars ($75.00); to my son Peter A. McKinney seventy-five dollars ($75.00); and to the children of my deceased daughter Lucinda Dix one hundred dollars ($100.00) to be equally divided between my said grandchildrenand paid them when they respectively twenty-one years of age.

Item 2 - I give and devise all of my real and personal estate to my sons, John B. McKinney and Felix G. McKinney, to them and their heirs forever, share and share alike, subject - however to the legacies hereinbefore mentioned to be paid two years after my death by my executors hereinafter named, which legacies I charge whom the real and personal estate given and devised in this item of my will.

Item 3 - It is my will and desire that the legacies bequeathed in item "1" shall not be payable or bear interest until two years after my death,

And lastly, I do hereby constitute and appoint my sons John B. McKnney and Felix G. McKinnney my lawful executors to all intents and purposes, to execute this my last will and testament, according to the true intent and meaing of the same, and every part and clause thereof, hereby revoking revoking and declaring utter void all other will and testaments by me heretofore made.

In testimony whenof I, the said Nathaniel McKinney do hereunto set my hand and seal this the __ day of __ A.D. 1887.

Signed, sealed, published and declared by the said Nathaniel McKinney to be his last will and testament, in the presence of us who at his request and in his presence do subscribeour names as witnesses, thereto.

The Milton Chronicle on Jan 29, 1875 mentioned him as being summoned by Superior Court in Caswell County, NC for a case of H. F. Brandon as administrator of Peter McKinney vs Henry McKinney, Sarah Moore, Nathaniel McKinney, W. R. McKinney and wife Mary A. Walker, Elisa McKinney, Jas. Swann and wife Rebecca and John Walker.

The defendants above named, if they be found within your county to appear at ofice of the Clerk of the Superior Court for the County of Caswell, within 20 days after the service of the summoner on them, exclusive of the day of such service, and answer the complaint, a copy of which will be deposited in the office of the Clk of S. Court for said county, within 10 days from the date of this summons, and let them take notice that if they fail to answer for the said complaint within that time, the plaintiff will apply to the Court for the relief demanded in the complaint. "Herof fail not, and of this summons make the return. Given under my hand and seal of said court, this 1st day of January 1875.
